$287,500 Alderfer Settlement Ends Litigation Over Allegedly False Advertising of Non-Organic Eggs

A $287,500 settlement is set to resolve a class action lawsuit that alleged Alderfer Family Farm LLC falsely advertised certain non-organic egg products as produced by “free roaming” hens.

The Alderfer settlement received preliminary courtapproval on April 4, 2025 and covers anyone in the United States who bought Alderfer non-organic eggs for personal or household use at any time between December 1, 2020 and the date the deal receives final approval from the court and has not already received a full refund for the purchase.

Class members who file a valid, timely claim form may receive $2.00 per carton of eggs purchased during the aforementioned time period.

To file a claim, class members can visit the settlement website, click on the “Submit a Claim” button in the top right corner, then click the “Start Your Claim” button at the bottom of the screen.

Alternatively, class members may download a PDF of the claim form to print, fill out, and return by mail to the settlement administrator.

Class members will be able to submit a claim for as many egg cartons as they can provide proof for. If you cannot provide proof of purchase, you will still be able to file a claim for up to two cartons of eggs.

All claims must be submitted by September 22, 2025.

There will be a court hearing on October 22, 2025 to determine whether the class action settlement will receive final approval. Should final approval be granted, and after any appeals are resolved, compensation will begin to be distributed to class members who filed a timely, valid claim form.

The class action lawsuit against Alderfer Family Farm LLC alleged that although the company advertised its eggs as produced by “free roaming” chickens, the chickens were in fact given incredibly limited indoor space and allotted only a small, “quasi-outdoor” space.
